Tudo bem que "usar" pode não ter problema, mas parece que jogar o
codificador mp3 dentro de um código GPL é ilegal.

Se isso tudo for verdade, significa que é ilegal usar mp3 player (ou
plugins) com licença GPL, que incluem: XMMS, MPlayer, Xine.
